Welcome to TaxMarg. These Terms of Service constitute a legally binding agreement between you and TaxMarg Darshak Private Limited. By accessing and using the TaxMarg website (taxmarghub.com) and our services, you agree to comply with and be bound by the following Terms. These terms are governed by the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020.
1. Acceptance of Terms
By creating an account, booking a service, or using our platform, you accept these terms. If you disagree with any part of these terms, you must not use our platform.
2. Description of Services & Transparency
TaxMarg provides professional advisory, taxation, compliance, and legal services. The information provided on our website is for general informational purposes and does not constitute legally binding advice until a formal service engagement is initiated.
Timelines: Any timelines presented for service completion (e.g., "Company Registration in 7 days") are estimates based on standard operating procedures. Actual completion times may vary significantly depending on external factors such as government portal availability, departmental processing times, and promptness of document submission by the client.
3. Client Responsibilities
To provide accurate services, you agree to:
- Provide true, accurate, and complete information and documentation when requested.
- Maintain the confidentiality of your account credentials.
- Ensure that any documents uploaded belong to you or that you have the legal right to submit them.
- Respond promptly to queries from our experts to avoid delays in filings or compliance.
We are not liable for any penalties, delays, or rejections from government portals resulting from inaccurate or delayed information provided by you.
4. Professional Fees and Payments
Fees for our services are listed on the platform or quoted individually. Payment must be made in full before the commencement of the specific service phase. Professional fees are strictly non-refundable once work has commenced (refer to our Refund Policy). Any government fees, challans, or penalties are the sole responsibility of the client and are not included in our professional fees unless explicitly stated.
5. Data Privacy and DPDP Compliance
We process your personal data in strict compliance with the Digital Personal Data Protection (DPDP) Act 2023. By using our services, you consent to the collection and processing of your data as outlined in our Privacy Policy. You retain full rights over your data, including the right to access, correct, and request erasure.
6. Intellectual Property
All content, branding, logos, software, and materials on the TaxMarg platform are the intellectual property of TaxMarg Darshak Private Limited and are protected by applicable copyright and trademark laws.
7. Limitation of Liability & IT Act Compliance
In accordance with Section 79 of the Information Technology Act, 2000, TaxMarg is not liable for third-party information or data hosted on the platform. Furthermore, while we strive to provide the highest quality of service, TaxMarg shall not be held liable for any indirect, incidental, or consequential damages arising out of the use of our services. Our maximum liability in any circumstance is limited to the professional fee paid by you for the specific service in question.
8. Modifications to Terms
We reserve the right to modify these terms at any time. Significant changes will be communicated via your registered email or through a notice on the platform. Continued use of the platform constitutes acceptance of the modified terms.
9. Governing Law and Jurisdiction
These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat.
